Assalamu Alaikum. UK revert here. Husband has Hanafi background, but we want a Salafi fatwa to reconcile. Under intense pressure from me, he said talaq 3 times in one breath. He had zero intention to divorce me and wants to save our marriage. Crucially, this happened right after intimacy, and we just confirmed I am pregnant from that intimacy. Does 3-in-1 count as 1 revocable divorce? Does the lack of intent, pressure, post-intimacy timing, and pregnancy render this void under the Sunnah?
All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad (
) is His slave and Messenger.
A divorce pronounced using an explicit expression of divorce – such as saying, "You are divorced" – does not require the husband to have intended divorce. Ibn Qudāmah
said in Al-Mughnī: "An explicit divorce does not require intention. Rather, it takes effect even without a specific intent, and there is no disagreement concerning this."
Pressure or persistent insistence does not constitute legal coercion (ikrāh), and therefore it does not prevent the divorce from taking effect.
The majority of scholars, including the four recognized schools of Islamic law, hold that pronouncing a threefold divorce in a single sitting counts as three divorces. They also maintain that pronouncing divorce after having marital relations does not prevent the divorce from taking effect.
However, Ibn Taymiyyah
held that a divorce pronounced during a period of purity in which the husband had intercourse with his wife does not take effect, and that a threefold divorce pronounced in one sitting counts as only a single divorce.
Al-Qurṭubī
said in Al-Mufhim: "The majority of the early scholars and the leading Imams held that it is binding and counts as three divorces, with no difference between pronouncing the three together in one statement or separately in multiple statements."
Ibn Taymiyyah
said, as quoted in Majmūʿ Al-Fatāwā: "If he divorces her three times in one statement or in several statements during the same period of purity, then according to the majority of scholars this is prohibited. They differed, however, regarding its legal effect. It was said that all three divorces take effect, and it was also said that only one divorce takes effect. This latter view is the stronger one."
Since matters of divorce are highly sensitive and can have serious legal consequences, we advise you to consult your local Islamic center or speak directly with a trustworthy and qualified scholar who can assess the specifics of your case.
